Abstract

Pesatnya perkembangan teknologi informasi yang menjadikan e-commerce sebagai bagian integral dari aktivitas ekonomi. Namun, juga menimbulkan tantangan hukum, terutama bagi afiliator yang berperan sebagai pihak ketiga dalam promosi produk. Rumusan masalahnya yaitu bagaimana penganturan dan perlindungan hukum bagi afiliator pada e-commerce di Indonesia. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai e-commerce dan perlindungan hukum bagi afiliator pada e-commerce di Indonesia. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan deskriptif analitis, melibatkan wawancara dengan afiliator dari platform e-commerce seperti Shopee, Tiktok Shop, dan Lazada. Hasil penelitian menunjukkan meskipun ada regulasi yang mengatur e-commerce dan adanya perjanjian afiliasi antara afiliator dan e-comerce, perlindungan hukum bagi afiliator masih belum optimal. Bentuk perlindungan preventif dalam penelitian ini adalah sebuah perjanjian elektronik yang termuat dalam setiap platform e-commerce serta perlindungan refresifnya dapat berupa non litigasi penyelesaian di luar pegadilan. Namun, jika tidak dapat diselesaikan secara non litigasi maka dapat dilakukan gugatan hukum secara litigasi. Simpulan pengaturan hukum yang mengatur mengenai perlindungan hukum bagi afiliator terdiri dari KUHPerdata, Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, Undang-Undang Nomor 7 Tahun 2014 tentang Perdagangan, Peraturan Pemerintah Nomor 71 Tahun 2019 dan Peraturan Pemerintah Nomor 80 Tahun 2019. Perlindungan hukum bagi afiliator dalam e-commerce di Indonesia masih lemah, terutama dalam pembayaran komisi dan kurangnya mekanisme penyelesaian sengketa yang efektif. Saran agar pemerintah dan lembaga terkait melakukan revisi dan penguatan terhadap regulasi yang mengatur e-commerce, khususnya yang berkaitan dengan perlindungan hak-hak afiliator. Hal ini termasuk penetapan standar yang jelas mengenai transparansi komisi dan prosedur penyelesaian sengketa.

The rapid development of information technology has made e-commerce an integral part of economic activity. However, it also raises legal challenges, especially for affiliates who act as third parties in product promotion. The formulation of the problem is: how the arrangement and legal protection for affiliates in e-commerce in Indonesia. This research aims to analyze the legal arrangements regarding e-commerce and legal protection for affiliates in e-commerce in Indonesia. This research uses an empirical juridical method with an analytical descriptive approach, involving interviews with affiliates from e-commerce platforms such as Shopee, Tiktok Shop, and Lazada. The results show that despite regulations governing e-commerce and the existence of affiliation agreements between affiliates and e-commerce, legal protection for affiliates is still not optimal. The form of preventive protection in this study is an electronic agreement contained in each e-commerce platform and the refressive protection can be in the form of non-litigation settlement outside the court. However, if it cannot be resolved in non-litigation then a lawsuit can be filed in litigation. The conclusion of legal arrangements governing legal protection for affiliates consists of the Civil Code, Law Number 11 of 2008 concerning Electronic Information and Transactions, Law Number 7 of 2014 concerning Trade, Government Regulation Number 71 of 2019 and Government Regulation Number 80 of 2019. Legal protection for affiliates in e-commerce in Indonesia is still weak, especially in commission payments and the lack of an effective dispute resolution mechanism. It is suggested that the government and relevant institutions should revise and strengthen the regulations governing e-commerce, especially those relating to the protection of affiliates' rights. This includes setting clear standards regarding commission transparency and dispute resolution procedures.
