Dengan adanya ulasan film dalam platform YouTube seperti yang ada dalam kanal “Series Review”, “Keramagz”, dan “Rio Bara bere” yang membuat ulasan film terhadap film series berjudul “Squid Game Season 2” dengan menggunakan naskah skenario film dan menayangkan cuplikan film yang dilindungi hak cipta dengan tidak memperhatikan izin dari pemegang hak cipta serta merugikan kepentingan wajar pemegang hak ciptanya. Tujuan penelitian ini untuk mengetahui pengaturan terkait pemegang hak cipta atas ulasan film dalam platform YouTube dan untuk mengetahui perlindungan hak cipta bagi pemegang hak cipta atas tindakan ulasan film dalam platform YouTube. Metode penelitian menggunakan pendekatan yuridis normatif, dengan teknik pengumpulan data sekunder berupa bahan hukum primer, sekunder, dan tersier melalui studi kepustakaan, serta dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa pengaturan hukum yang ada seperti Pasal 9, Pasal 113, Pasal 40 ayat (1), dan Pasal 44 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik terdapat kekosongan hukum berupa aturan yang menilai apakah suatu penggunaan masuk kategori fair use atau pelanggaran. Perlindungan hukumnya terdiri dari perlindungan preventif berupa aturan, peran lembaga terkait, dan edukasi terhadap konten kreator pemula, serta perlindungan refresif terdiri dari penutupan konten oleh platform YouTube, penyelesaian sengketa baik secara perdata melalui pengadilan niaga maupun pidana atau melalui Alternatif Penyelesaian Sengketa. Simpulan dari penelitian ini yaitu Pengaturan hukum yang ada lemah dalam mendefinisikan batasan penggunaan wajar film. Perlindungan hukumnya mencakup upaya preventif dan represif. Saran dari penelitian ini perlu adanya regulasi teknis yang mengatur indikator batasan penggunaan wajar dari suatu karya yang dilindungi oleh hak cipta, serta diperlukan adanya Lembaga manajemen kolektif sebagai pihak ketiga antara pemegang hak cipta film dan pengulas film sehingga menciptakan dunia kreatif yang sehat.

The presence of film reviews on YouTube platforms such as the channels “Series Review,” “Keramagz,” and “Rio Bara Bere” which provide reviews of the film series titled “Squid Game Season 2” by using copyrighted film scripts and displaying film clips without the permission of the copyright holders and thereby harming the legitimate interests of the copyright holders, has raised legal concerns. The purpose of this research is to identify the regulations related to copyright holders regarding film reviews on the YouTube platform and to examine the legal protection available to copyright holders against such film review actions. The research method uses a normative juridical approach, with secondary data collection techniques consisting of primary, secondary, and tertiary legal materials through literature study, and is analyzed using qualitative descriptive methods. The result of the research findings show that the existing legal regulations, such as Article 9, Article 113, Article 40 paragraph (1), and Article 44 paragraph (1) of Law Number 28 of 2014 concerning Copyright and Law Number 1 of 2024 concerning Electronic Information and Transactions, reveal a legal gap in terms of rules determining whether a particular usage falls under fair use or constitutes infringement. Legal protection consists of preventive measures in the form of regulations, the role of relevant institutions, and education for beginner content creators, as well as repressive protection including content removal by the YouTube platform, dispute resolution either civilly through commercial courts or criminally, or through Alternative Dispute Resolution. The conclusion of this research is that the current legal regulations are weak in defining the boundaries of fair use of films. Legal protection includes both preventive and repressive efforts. The research suggests the need for technical regulations that set indicators for the limits of fair use of copyrighted works, and the establishment of a collective management organization as a third party between film copyright holders and film reviewers, to create a healthy creative environment.
