ABSTRAK
Partisipasi masyarakat merupakan elemen penting dalam sistem demokrasi yang dapat mendorong lahirnya peraturan daerah yang responsif terhadap kebutuhan masyarakat. Meskipun telah diatur dalam berbagai peraturan perundang-undangan seperti Undang-Undang Nomor 12 Tahun 2011 dan peraturan pelaksanaannya, implementasi partisipasi masyarakat masih menghadapi berbagai hambatan. Rumusan masalah dalam penelitian ini adalah bagaimana pengaturan partisipasi masyarakat dalam pembentukan peraturan daerah dan bagaimana efektivitas pelaksanaannya di Kabupaten Kuningan. Tujuan penelitian yaitu untuk menganalisis pengaturan partisipasi masyarakat berdasarkan hukum positif serta mengevaluasi efektivitasnya dalam penyusunan tiga peraturan daerah di Kabupaten Kuningan. Secara teoritis, penelitian ini berguna untuk memperkaya kajian ilmu hukum, dan secara praktis memberikan rekomendasi perbaikan bagi pemerintah daerah dalam mewujudkan proses legislasi yang partisipatif. Metode penelitian ini menggunakan pendekatan yuridis-empiris dengan teknik pengumpulan data melalui studi pustaka dan wawancara. Hasil penelitian menunjukkan bahwa secara normatif pengaturan partisipasi masyarakat sudah ada, namun implementasinya belum berjalan optimal dan cenderung formalitas. Hambatan utama antara lain kurangnya sosialisasi, terbatasnya akses informasi, dan rendahnya kesadaran hukum masyarakat. Mekanisme konsultasi publik juga belum efektif. Simpulan penelitian ini menyatakan bahwa efektivitas partisipasi masyarakat masih rendah dan belum transparan. Saran, diperlukan langkah strategis seperti pemanfaatan teknologi informasi, peningkatan pengetahuan hukum masyarakat, dan pembentukan forum komunikasi publik yang berkelanjutan.

ABSTRACT
Public participation is an essential element in a democratic system that can encourage the creation of regional regulations that are responsive to the needs of the community. Although it has been regulated in various laws and regulations such as Law Number 12 of 2011 and its implementing regulations, the implementation of public participation still faces several obstacles. The problems in this study are how public participation is regulated in the formation of regional regulations and how effective its implementation is in Kuningan Regency. The aim of this research is to analyze the regulation of public participation based on applicable positive law and to evaluate its effectiveness in the drafting of three regional regulations in Kuningan Regency. Theoretically, this research contributes to the development of legal scholarship, while practically it provides recommendations for local governments to improve participatory legislative processes. This research uses a juridical-empirical approach with data collection techniques through literature study and interviews. The research results show that normatively, the regulation of public participation already exists, but its implementation has not run optimally and tends to be merely formal. The main obstacles include lack of dissemination of draft regulations, limited access to information, and low legal awareness among the public. In addition, the existing public consultation mechanisms have not worked effectively. The conclusion of this study is that the effectiveness of public participation remains low. Therefore, strategic steps are needed, such as utilizing information technology in the legislative process, increasing legal awareness, and establishing sustainable public communication forums.
