KEWENANGAN POLISI KEHUTANAN DALAM PENANGGULANGAN TINDAK PIDANA ILLEGAL LOGGING DI TAMAN NASIONAL GUNUNG CIREMAI.

Abstract
Kejahatan illegal logging di Taman Nasional Gunung Ciremai merupakan ancaman serius dalam pelestarian hutan dan lingkungan hidup. Kewenangan polisi kehutanan memegang peran penting dalam upaya penanggulangannya, maka diperlukan penelitian mengenai kewenangan polisi kehutanan dalam penanggulangan tindak pidana illegal logging di Taman Nasional Gunung Ciremai. Rumusan masalah bagaimana pengaturan tindak pidana illegal logging berdasarkan peraturan perundang-undangan dan bagaimana penerapan kewenangan polisi kehutanan dalam penanggulangan tindak pidana illegal logging di Taman Nasional Gunung Ciremai. Tujuan penelitian ini untuk mengetahui tindak pidana illegal logging berdasarkan peraturan perundang-undangan serta kewenangan polisi kehutanan dalam penanggulangan tindak pidana illegal logging di Taman Nasional Gunung Ciremai. Metode penelitian menggunakan yuridis-empiris, tahap penelitian dengan studi kepustakaan dan penelitian lapangan, teknik pengumpulan dengan data primer, sekunder dan tersier serta alat pengumpulan data dengan obseravasi dan wawancara, analisis data dengan kualitatif. Hasil penelitian bahwa pengaturan tindak pidana illegal logging diatur dalam Pasal 12, Pasal 19, Pasal 82, Pasal 83, dan Pasal 87 Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan dan kewenangan polisi kehutanan diatur dalam Pasal 51 ayat (2) Undang-Undang Nomor 41 Tahun 1999 Tentang Kehutanan dan Pasal 4 ayat (2) Peraturan Menteri Kehutanan Republik Indonesia Nomor P.75/Menhut-II/2014 tentang Polisi Kehutanan yang menjadi regulasi polisi kehutanan dalam melakukan penanggulangan tindak pidana illegal logging di Taman Nasional Gunung Ciremai. Polisi kehutanan dalam melakukan tugasnya masih menghadapi berbagai hambatan seperti, faktor wilayah yang luas tidak sebanding dengan jumlah personel, faktor topologi wilayah yang parsial, terlalu banyak akses masuk ke wilayah konservasi, keterbatasan sarana dan prasana, potensi hutan yang melimpah, tidak memiliki kewenangan dalam penyidikan, dan masyarakat yang belum mengetahui secara menyeluruh kawasan Taman Nasional Gunung Ciremai . Simpulan bahwa pengaturan tindak pidana illegal logging diatur dalam Pasal 12, Pasal 19, Pasal 82, Pasal 83 dan Pasal 87 Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan dan kewenangan polisi kehutanan dalam penanggulangan tindak pidana illegal logging adalah melalui upaya preemtif, preventif dan represif. Saran agar penegak hukum harus konsisten dan tegas dalam menindak pelaku tindak pidana illegal logging untuk menciptakan efek jera serta perlu adanya peningkatan sarana dan prasana untuk mendukung tugas polisi kehutanan di lapangan

The crime of illegal logging in Ciremai Mountain National Park is a serious threat to forest and environmental conservation. The authority of the forestry police plays an important role in efforts to overcome it, so research is needed on the authority of the forestry police in overcoming illegal logging crimes in the Ciremai Mountain National Park. The formulation of the problem is how the regulation of illegal logging crimes based on legislation and how the application of the authority of the forestry police in overcoming illegal logging crimes in the Ciremai Mountain National Park. The purpose of this research is to find out the criminal act of illegal logging based on legislation and the authority of the forestry police in overcoming illegal logging crimes in the Ciremai Mountain National Park. The research method uses juridical-empirical. This research uses literature studies and field research, collection techniques with primary, secondary and tertiary data and data collection tools with observation and interviews, qualitative data analysis. The results of the study show that the regulation of illegal logging crimes is regulated in Article 12, Article 19, Article 82, Article 83, and Article 87 of Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction and the authority of the forestry police is regulated in Article 51 paragraph (2) of Law Number 41 of 1999 concerning Forestry and Article 4 paragraph (2) of the Regulation of the Minister of Forestry of the Republic of Indonesia Number P.75 / Menhut-II / 2014 concerning Forestry Police which is the regulation of the forestry police in overcoming illegal logging crimes in the Ciremai Mountain National Park. The forestry police in carrying out their duties still face various obstacles such as, the factor that the vast area is not proportional to the number of personnel, the partial topological factor of the area, too much access to the conservation area, limited facilities and infrastructure, abundant forest potential, lack of authority in investigations, and people who do not know the entire Mount Ciremai National Park area. It is concluded that the regulation of illegal logging crimes is regulated in Article 12, Article 19, Article 82, Article 83 and Article 87 of Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction and the authority of the forestry police in overcoming illegal logging crimes is through preemptive, preventive and repressive efforts. The suggestions from this research are that law enforcers should be consistent and firm in taking action against perpetrators of illegal logging crimes to create a deterrent effect and the need for increased facilities and infrastructures to support the duties of the forestry police in the field.
