Abstract

Pengadaan tanah adalah kegiatan menyediakan tanah dengan cara memberi ganti kerugian yang layak dan adil kepada pihak yang berhak. Namun sebagian pengadaan tanah yang dilaksanakan di Kabupaten Kuningan masih terjadi kendala dikarenakan belum terjadinya kesepakatan antara warga pemilik tanah yang belum mendapatkan ganti rugi dengan pemerintah atau ketidaksesuaian harga ganti rugi yang dirasakan oleh masyarakat yang terkena pembebasan tanah dan kurang optimalnya kinerja panitia pengadaan tanah khususnya dalam proses penyuluhan dilapangan terhadap warga yang belum mendapatkan ganti kerugian. Tujuan penelitian ini untuk mengetahui pengaturan yang berlaku tentang pengadaan tanah untuk kepentingan umum menurut peraturan perundang-undangan serta untuk mengetahui prosedur dan mekanisme pengadaan tanah untuk Pembangunan berdasarkan Undang-Undang Nomor 2 tahun 2012 tentang pengadaan tanah bagi Pembangunan untuk kepentingan umum. Penelitian ini menggunakan tipe Penelitian yuridis empiris yaitu penelitian yang dilakukan secara langsung dilapangan kemudian akan dihubungkan dengan peraturan perundang-undangan yang berlaku dan teori hukum yang ada, Teknik pengumpulan data primer dan sekunder serta alat pengumpulan data dengan studi lapangan dengan cara observasi dan wawancara. Hasil penelitian menunjukan bahwa Pelaksanaan Pengadaan Tanah Untuk Kepentingan Umum Berdasarkan Pasal 13, Pasal 15 dan Pasal 17 Undang- Undang Nomor 2 Tahun 2012 Tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum yang meliputi beberapa tahapan yaitu; perencanaan, persiapan, pelaksanaan, dan penyerahan hasil serta penerapan prosedur pengadaan tanah diKabupaten Kuningan untuk Jalan Lingkar Timur telah sesuai dengan peraturan perundang-undangan. Simpulan dalam penelitian ini bahwa pengaturan pengadaan tanah untuk kepentingan umum diatur dalam perundang-undangan serta prosedur dan mekanisme dalam pelaksanaan pengadaan tanah untuk kepentingan umum telah sesuai dengan ketentuan yang tercantum dalam peraturan perundang- undangan. Saran agar pelaksaan pengadaan tanah sesuai dengan peraturan perundang-undnagan maka harus adanya pemahaman mendalam, kepatuhan hukum, keterlibatan berbagai pihak terkait, edukasi penjelasan kepada masyarakat, memiliki alternatif Solusi, penanganan konflik serta evaluasi dan pembelajaran setelah proses pengadaan tanah selesai guna meningkatkan efektivitas dan efisiensi proses pengadaan tanah di masa mendatang.

Land procurement is the activity of providing land by providing adequate and fair compensation to the entitled parties. However, some land acquisitions carried out in Kuningan Regency still experience problems due to the lack of agreement between land owners who have not received compensation and the government or the incompatibility of compensation prices felt by the people affected by land acquisition and the less than optimal performance of the land acquisition committee, especially in the process counseling in the field for residents who have not received compensation. The aims of this research are to find out the applicable regulations regarding land procurement for public purposes based on statutory regulations and to find out the procedures and mechanisms for land acquisition for development based on Law Number 2 of 2012 concerning land acquisition for development for public purposes. This research uses the Empirical Juridical Research type, namely research carried out directly in the field which will then be connected to applicable regulations and existing legal theories, primary and secondary data collection techniques as well as data collection tools using field studies by means of observation and interviews. The results of the research show that the Implementation of Land Acquisition for Public Interest is Based on Article 13, Article 15 and Article 17 of Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest which includes several stages, namely; planning, preparation, implementation and delivery of results as well as implementation of land acquisition procedures in Kuningan Regency for the East Ring Road are in accordance with statutory regulations. The conclusion of this research is that the regulation of land acquisition for the public interest is regulated in statutory regulations and the procedures and mechanisms for implementing land acquisition for the public interest are in accordance with the provisions contained in the statutory regulations. Suggestions so that the implementation of land acquisition is in accordance with statutory regulations, there should be in-depth understanding, legal compliance, involvement of various related parties, educational explanations to the community, having alternative solutions, handling conflicts as well as evaluation and learning after the land acquisition process is completed in order to increase effectiveness and efficiency future land acquisition process.
