Abstract

Penelitian ini mengkaji prosedur aanmaning sebagai tahap krusial dalam pelaksanaan eksekusi putusan perdata yang bersifat kondemnatoir di Pengadilan Negeri Kuningan. Putusan pengadilan yang telah berkekuatan hukum tetap tidak selalu dilaksanakan secara sukarela oleh pihak yang kalah, sehingga diperlukan tindakan eksekusi oleh pengadilan. Sebelum dilaksanakan eksekusi paksa, hukum acara perdata mengatur adanya prosedur aanmaning, yaitu peringatan atau teguran resmi dari Ketua Pengadilan kepada termohon eksekusi agar melaksanakan putusan secara sukarela dalam jangka waktu tertentu. Aanmaning memiliki peranan penting dalam mewujudkan asas kepastian hukum, keadilan, serta peradilan yang sederhana, cepat, dan biaya ringan. Akan tetapi, efektivitas prosedur aanmaning sering menghadapi berbagai hambatan, seperti rendahnya kesadaran hukum masyarakat, ketidakhadiran termohon, serta kendala teknis dalam pelaksanaan eksekusi. Penelitian ini menggunakan metode yuridis empiris dengan analisis berdasarkan Teori Negara Hukum dan Teori Efektivitas Hukum. Hasil penelitian menunjukkan bahwa pengaturan aanmaning telah memiliki dasar hukum yang jelas dalam Pasal 196 HIR, Pasal 207 RBg, Undang-Undang Nomor 48 Tahun 2009, Kitab Undang-Undang Hukum Perdata, serta didukung oleh SEMA dan SK Dirjen Badilum Nomor 40/DJU/SK/HM.02.3/1/2019. Namun, efektivitas pelaksanaannya belum optimal. Dari enam perkara eksekusi, hanya dua perkara yang berhasil dilaksanakan secara sukarela, sedangkan perkara lainnya mengalami hambatan seperti non-executable, pencabutan perkara, kurangnya peminat pada objek lelang, dan rendahnya kesadaran hukum masyarakat. Simpulan penelitian ini menegaskan bahwa keberhasilan aanmaning sangat bergantung pada pendekatan persuasif hakim serta itikad baik para pihak. Oleh karena itu, disarankan agar pengaturan yang telah ada tetap dipertahankan dan dioptimalkan guna meningkatkan kepatuhan hukum masyarakat demi terwujudnya kepastian hukum

This study examines the aanmaning procedure as a crucial stage in the execution of condemnatory civil judgments at the Kuningan District Court. Court decisions with permanent legal force are not always voluntarily complied with by the losing party, thus requiring court intervention through execution. Prior to forced execution, civil procedural law mandates the aanmaning procedure, which is an official warning issued by the Chief Judge to the respondent, ordering compliance within a specified period. Aanmaning plays an important role in ensuring legal certainty, justice, and a simple, fast, and low-cost judicial process. However, its effectiveness often faces obstacles, including low public legal awareness, the absence of the respondent, and technical constraints in execution. This research employs an empirical juridical method, data analysis using the Theory of the Rule of Law and the Theory of Legal Effectiveness. The findings show that aanmaning is clearly regulated under Article 196 of the HIR, Article 207 of the RBg, Law Number 48 of 2009, Indonesian Civil Code, as well as supported by Supreme Court Circular Letters and the Decree of the Director General of General Courts Number 40/DJU/SK/HM.02.3/1/2019. Nevertheless, its implementation remains suboptimal. Of six execution cases studied, only two were successfully carried out voluntarily, while others encountered obstacles such as non-executable status, case withdrawal, lack of interest in auction objects, and low legal awareness. In conclusion, the success of aanmaning depends on judges’ persuasive approach and the good faith of the parties. Therefore, it is recommended that existing arrangements be maintained and optimized to enhance public legal compliance and ensure legal certainty.
