Abstract

Penerapan konsep Non-Conviction Based Asset Forfeiture dalam tindak pidana korupsi menjadi penting mengingat tingginya kerugian keuangan negara yang tidak sebanding dengan tingkat pemulihan aset. Sistem yang berlaku saat ini masih berorientasi pada conviction based asset forfeiture yang mensyaratkan adanya putusan pidana berkekuatan hukum tetap, sehingga menimbulkan hambatan ketika pelaku meninggal dunia, melarikan diri, atau tidak dapat dihadirkan dalam persidangan. Penelitian ini bertujuan untuk menganalisis pengaturan hukum terkait Non-Conviction Based Asset Forfeiture serta mengkaji penerapannya sebagai reformulasi hukum dalam mengoptimalkan pemulihan kerugian keuangan negara. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan, serta dianalisis secara kualitatif melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa pengaturan Non-Conviction Based Asset Forfeiture di Indonesia belum komprehensif dan masih tersebar dalam berbagai peraturan. Secara internasional, konsep ini diakui dalam United Nations Convention Against Corruption khususnya Pasal 54 ayat (1) huruf c yang memungkinkan perampasan aset tanpa putusan pidana dalam kondisi tertentu. Hal ini memberikan dasar legitimasi bagi penerapannya di Indonesia. Kesimpulannya, Non-Conviction Based Asset Forfeiture merupakan alternatif yang relevan untuk mengoptimalkan pemulihan kerugian keuangan negara, namun implementasinya masih menghadapi kendala normatif dan kelembagaan. Maka, disarankan pembentukan Undang-Undang Perampasan Aset yang komprehensif guna menjamin kepastian hukum, efektivitas penegakan hukum, serta perlindungan hak asasi manusia.

The Non-Conviction-Based Asset Forfeiture concept is critical in corruption cases, considering the substantial state financial losses that far exceed asset recovery rates. The current system relies on conviction-based forfeiture, which requires a final criminal verdict and complicates recovery if the perpetrator dies, absconds, or is unavailable for court proceedings. This study analyzes legal frameworks governing Non-Conviction-Based Asset Forfeiture and evaluates its implementation as a legal reform to enhance state recovery of financial losses. A normative juridical method is used, applying statutory, conceptual, and comparative approaches, as well as qualitative literature analysis. Findings show that Indonesia’s asset forfeiture regulations are incomplete and fragmented. Internationally, the principle appears in the United Nations Convention Against Corruption, Article 54(1)(c), permitting asset confiscation without conviction under specified conditions validating its potential use in Indonesia. Ultimately, Non-Conviction-Based Asset Forfeiture is a viable option for optimizing state loss recovery, though normative and institutional challenges persist. A comprehensive Asset Forfeiture Law is advised to guarantee legal certainty, effective enforcement, and human rights protection.
