ABSTRAK
Penelitian ini mengkaji penerapan Peraturan Kepala Kepolisian Republik Indonesia Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Restorative Justice pada kasus tindak pidana penipuan dengan studi kasus di Polres Kuningan. Lahirnya regulasi ini merupakan respons atas kebutuhan alternatif penyelesaian perkara di luar jalur litigasi yang lebih menekankan pada pemulihan (restoration) dibandingkan penghukuman (punishment). Rumusan masalah dalam penelitian ini meliputi bagaimana penerapan Perkapolri Nomor 8 Tahun 2021 pada kasus penipuan di Polres Kuningan, serta faktor pendukung dan penghambat implementasinya. Metode penelitian yang digunakan adalah yuridis-empiris, dengan pendekatan normatif terhadap regulasi yang berlaku dan analisis empiris melalui wawancara serta data lapangan. Hasil penelitian menunjukkan bahwa secara normatif Perkapolri Nomor 8 Tahun 2021 memberikan landasan hukum yang jelas dalam penerapan keadilan restoratif, khususnya untuk perkara tindak pidana ringan atau yang memiliki potensi pemulihan. Namun, implementasi di lapangan masih menghadapi berbagai kendala, antara lain keterbatasan pemahaman aparat penegak hukum mengenai konsep restorative justice, resistensi budaya hukum yang masih berorientasi retributif, keterbatasan sumber daya manusia maupun anggaran, serta minimnya sosialisasi kepada masyarakat. Sementara itu, faktor pendukung implementasi antara lain adanya dasar hukum yang jelas, kemauan beberapa aparat untuk mengedepankan perdamaian, serta penerimaan sebagian masyarakat terhadap pendekatan yang lebih humanis. Kesimpulannya, penerapan restorative justice dalam kasus penipuan di Polres Kuningan belum berjalan optimal, sehingga dibutuhkan peningkatan kapasitas aparat, sosialisasi yang lebih luas, serta penguatan koordinasi antar lembaga penegak hukum agar tujuan keadilan, kemanfaatan, dan kepastian hukum dapat tercapai.

ABSTRACT
This study examines the implementation of the Indonesian National Police Chief Regulation Number 8 of 2021 concerning the Handling of Criminal Acts Based on Restorative Justice in cases of fraud, with a case study at the Kuningan Police Resort. The formulation of this regulation is a response to the need for an alternative dispute resolution method outside the litigation process, one that places more emphasis on restoration rather than punishment. The research questions in this study include how the implementation of National Police Chief Regulation Number 8 of 2021 is carried out in fraud cases at the Kuningan Police Resort, as well as the supporting and inhibiting factors. The research method used is juridical-empirical, with a normative approach to the applicable regulations and an empirical analysis through interviews and field data. The results show that, normatively, National Police Chief Regulation Number 8 of 2021 provides a clear legal basis for the application of restorative justice, especially for minor criminal offenses or those with the potential for restoration. However, the implementation in the field still faces various obstacles, including the limited understanding of law enforcement officials regarding the concept of restorative justice, the resistance of a legal culture that is still retribution-oriented, limited human resources and budget, and minimal public outreach. Meanwhile, the supporting factors for implementation include the existence of a clear legal basis, the willingness of some officials to prioritize peaceful resolution, and the acceptance by some members of the public of a more humane approach. In conclusion, the application of restorative justice in fraud cases at the Kuningan Police Resort has not yet been optimal. Therefore, there is a need to increase capacity among officials, broader public outreach, and strengthened coordination among law enforcement agencies to achieve the goals of justice, utility, and legal certainty.
